Privacy Policy & Data Protection
This privacy policy is intended to provide information on the manner in which SEALK, a simplified joint stock company registered in the Rennes Trade and Companies Register under number 838 751 428, whose registered office is located at 74 rue de Paris, 35000 Rennes (hereinafter “SEALK”), in its capacity as data controller, collects, processes and retains personal data relating to users of its website (hereinafter the “Personal Data”). SEALK is part of Datasite LLC and its affiliates (“Datasite”)
SEALK is very concerned about the security and confidentiality of users’ Personal Information. In this regard, SEALK thus undertakes to process the Personal Data of users in compliance with all applicable laws and regulations, and in particular the General Data Protection Regulation No. 2016/679 of April 27, 2016 (or “GDPR”), as well as the Law No. 78-17 of January 6, 1978 relating to Data Processing, Files and Liberties in its current version (together the “Applicable Regulations”). SEALK reserves the right to modify this Privacy Policy at any time, in whole or in part. Users will be informed of such changes by any means. If substantial changes are made to the Privacy Policy, we will post a prominent announcement.
1. DATA COLLECTED AND PURPOSES
When you visit the website https://sealk.co/ (the “Site”), your Personal Data may be processed by SEALK for the following purposes
- To respond to your requests for information submitted via our contact form, in order to obtain information or documentation on SEALK’s activities, or to be contacted again, based on SEALK’s legitimate interest in responding to the requests made to it;
- To subscribe to the newsletter and send you information and news about SEALK’s activities, based on SEALK’s legitimate interest in informing its prospects of its offers and new products;
- To process, evaluate and follow up on job applications and arrange interviews, based on the performance of pre-contractual measures, and based on SEALK’s legitimate interest in organizing their recruitment process and recruiting qualified personnel for the positions offered.
- To perform our obligations under any contract or engagement that we may have with you or your organization (i.e. to register you as a (potential) client, to provide services, to process billing etc.)
- To process your Personal Data in order to comply with certain legal obligations imposed upon us, including but not limited to anti-money laundering, fraud and crime prevention.
- To operate, audit, improve the website and understand your preferences for our legitimate interests in developing our services
From time to time, we may obtain information about you from third-party sources, such as public databases and websites, resellers and distributors, joint marketing or business partners, security and fraud detection firms and social media platforms. Examples of the information we may receive from other sources include contact information from business partners with whom we operate co-branded events, services, and marketing campaigns.
Where we rely on our legitimate interest, we will balance that against our applicable legal obligations to you. We will not collect additional categories of Personal Data or use the Personal Data we collected for materially different, unrelated, or incompatible purposes without providing you notice.
We do not collect sensitive Personal Data. Unless we specifically make a request and it is relevant to the services that we provide, we ask that you do not provide us with any sensitive Personal Data (meaning information revealing racial or ethnic origin, political opinions, religion or philosophical beliefs, trade union membership, genetic, health, or biometric information, information about sex life or sexual orientation, or criminal convictions or offences) through our websites or mobile applications, or otherwise to us.
If we request your consent to use your Personal Data, you have the right to withdraw your consent any time in the manner indicated when we requested the consent or by contacting us. If you have consented to receive marketing communications from our third-party partners, you may withdraw your consent by contacting those partners directly.
This Website may contain hyperlinks to websites that are not operated by us. These hyperlinks are provided for your reference and convenience only and do not imply any endorsement of the activities of these third-party websites or any association with their operators. We do not control these websites and are not responsible for their operation, data, or privacy practices. We urge you to review any privacy notice posted on any site you visit before using the site or providing any Personal Data about yourself.
SEALK may also collect usage data through the use of cookies, as defined in Section 5 below, based on its legitimate interest in performing analyses on the use of the Site in order to improve it, and to ensure its security.
2. RECIPIENTS OF PERSONAL DATA
For the purposes of the processing described above, your Personal Data may be communicated to Datasite, SEALK’s and Datasite’s service providers and subcontractors acting on its behalf and under their instructions, in particular to IT service providers (storage/hosting, support, chatbox that creates AI generated responses, account management, marketing, surveys, prevent fraud, analytical service providers) or to SEALK’s or Datasite’s lawyers, accountants or other advisors.
When we disclose your Personal Data for a business purpose, we enter a contract that requires that all third-party processors process your Personal Data with the same level of protection and in a manner consistent with the uses agreed upon in this privacy policy.
3. CONSERVATION OF DATA
SEALK will keep Personal Data only for the time necessary for the purposes of processing.
The Personal Data of persons who wish to obtain information about SEALK and who have signed up for the newsletter will be kept for a maximum of three (3) years after their last contact with SEALK.
Applicants’ Personal Data will be deleted immediately if their application is not accepted. However, SEALK may retain applications and CVs for up to two years if the candidate’s profile is of interest, in order to contact the candidate for future opportunities.
Notwithstanding the foregoing, SEALK reserves the right to retain some of the Personal Data in an intermediate archive for the applicable statute of limitations in order to preserve its rights in the event of litigation.
4. RIGHTS OF THE PERSONS CONCERNED
Under the conditions of the Applicable Regulations, you may exercise, at any time, the rights detailed below:
- right of access: you may obtain information on the nature, origin and use of your Personal Data. In case of transmission of your Personal Data to third parties, you can also obtain information concerning the identity or the categories of such recipients;
- right of rectification: you may request that inaccurate or incomplete Personal Data be rectified or completed;
- right to erasure: you may request the erasure of your Personal Data, in particular if your Personal Data are no longer necessary for the processing carried out. SEALK shall proceed to the erasure of the Personal Data as soon as possible, except in the cases provided for by the Applicable Regulations;
- right to limitation of processing: you may request that your Personal Data be made temporarily inaccessible in order to limit their future processing in the situations provided for by the Applicable Regulations;
- right to object: you may object to the processing of your Personal Data on grounds relating to your particular situation unless there are compelling legitimate grounds for the processing which override such interests, rights and freedoms or if it is necessary for the establishment, exercise or defense of legal claims;
- right to portability: in the circumstances provided for by the Applicable Regulations, you may request to receive communication of the Personal Data you have submitted to SEALK, in a structured and commonly used format;
- the right to communicate instructions regarding the processing of your Personal Data in the event of your death.
If you have any questions, requests, or complaints about our privacy practices, you may contact us by e-mailing [email protected]. We endeavor to respond to a verifiable request within any legally required time limit or otherwise within thirty (30) days of its receipt, which thirty (30) day period may be extended with written notification, and deliver our response (or reasons we cannot comply with a request) via electronic mail. We will not discriminate against you for exercising any of your rights. We may make a charge, if excessive, repetitive, or manifestly unfounded.
5. COOKIES
The Site uses a technology called “cookies”. A cookie is a small text file that is placed on a user’s hard drive by the server of a web page. Cookies allow us to provide additional functionality to the Site or help us analyze the use of the Site more accurately. You are informed that during your visits to the Site, SEALK may install the following categories of cookies on your terminal equipment:
Audience measurement cookies:
- The purpose of these cookies is to produce statistics concerning visits to the Site: tests, measurements and analysis of audience, attendance, navigation and performance.
- Their operation is based on an identification of “unique visitors” which then allows to measure the number of visits, the number of pages seen, the duration and the path of navigation, the activity and the interactivity of the visitor with the Site, the frequency of visits (Site or pages of the Site), the performance of various pages of the Site…
- These cookies allow us to understand how users arrive on the Site and to reconstruct their journey. They also allow us to adapt the Site to users’ requests and browsing preferences.
- In this respect, SEALK uses Google Analytics.

6. AUTOMATED DECISION MAKING
You have the right not to be subject to automated decision making (e.g., profiling) that significantly affects you. The exercise of this right is not available to you in the following cases:
- The automated decision is required to enter into, or perform, a contract with you;
- We have your explicit consent to make such a decision;
- The automated decision is authorised by local law of an EU member state.
Unless the automated decision is authorized by local or EU law, you still have the right to obtain human intervention in respect of the decision, to express your point of view and to contest the decision.
7. TRANSFERS
Your Personal Data may be transferred to, and processed in, countries other than the country in which you are resident. These countries may have data protection laws that are different to the laws of your country, and in some cases, may not provide an adequate level of protection for Personal Data. With regard to our role as a data Processor or service provider, our online services servers are located in France and we may process your information in jurisdictions where our affiliates and third-party service providers are located.
We have taken appropriate safeguards to require that your Personal Data will remain protected in accordance with applicable law for such processing or transfer. These safeguards include implementing the European Commission’s Standard Contractual Clauses for transfers of Personal Data between us and our affiliates and third-party service providers to whom we transfer the Personal Data which require these companies to protect Personal Data they process from the EEA or Switzerland in accordance with Applicable Regulations.
8. DATA SECURITY
We will maintain, monitor, and enforce reasonable organizational, administrative, technical, and physical safeguards to protect the security and confidentiality of your Personal Data from loss, misuse, unauthorized access or disclosure. We limit access to your Personal Data to those employees, agents, contractors and other third parties who have a business need to know. They will only process your Personal Data on our instruction, and they are subject to a duty of confidentiality.
9.DATA PRIVACY FRAMEWORK
Datasite maintains compliance with the EU-U.S. Data Privacy Framework (and the UK Extension), and the Swiss-U.S. Data Privacy Framework and has certified to the Department of Commerce that it adheres to each Framework’s Principles regarding the collection, use and retention of Personal Data as well as the notice, choice, security, data integrity, access and enforcement requirements from European Union member countries, the United Kingdom and Switzerland. If there is any conflict between the terms in this Privacy Notice and the Principles, the Principles shall govern.
